Margaret MacLean is a skilled litigator with nearly twenty years’ experience representing clients on both sides of the “v.” She leads Lowey’s appellate litigation practice and has been instrumental in securing Second Circuit reversals in multiple antitrust actions against financial institutions. In addition to these financial product price-fixing cases, Ms. MacLean litigates antitrust actions in industries ranging from pesticides to containerboard, as well as data privacy actions against some of the nation’s largest technology companies.

Representative Successes

  • Obtained reversal of district court’s dismissal of Mexican banks in government bond price-fixing action. See Oklahoma Firefighters Pension & Ret. Sys. v. Banco Santander (Mexico) S.A. Institucion de Banca Multiple, 92 F.4th 450, 458 (2d Cir. 2024).
  • Presented winning briefs and oral arguments in large antitrust actions challenging multi-bank price fixing conspiracies, including FrontPoint Australian Opportunities Trust, et al. v. UBS AG et al., No. 13-cv-2811 (PKC) (S.D.N.Y.) ($651.5 million in settlements to date); In re GSE Bonds Antitrust Litigation, No. 19-cv-1704 (S.D.N.Y.) ($386.5 million in settlements); Fund Liquidation Holdings LLC, et al. v. UBS AG et al., No. 15-cv-5844 (GBD) (S.D.N.Y.) ($364.5 million in settlements to date); Fund Liquidation Holdings LLC v. Citibank, N.A., et al., 16-cv-5263 (S.D.N.Y.) ($155.49 million in settlements).
  • Key team member in data privacy actions challenging unlawful recording and use of data through voice assistant programs. See Lopez v. Apple, Inc., No. 19-cv-4577 (N.D. Cal.) ($95 million settlement); In re Google Assistant Privacy Litig., No. 19-CV-4286 (N.D. Cal.) ($68 million settlement).
