Ms. Ruggiero is a Partner in the Healthcare and Antitrust practice group who represents major health insurers in high-stakes recovery litigation involving pharmaceutical overcharges, fraud, and anticompetitive conduct. She has played key roles in matters seeking—and securing—hundreds of millions to billions of dollars in damages on behalf of payers across the U.S. healthcare market.

Representative Successes

  • Represented 39 health insurers—accounting for approximately 60% of the U.S. non-governmental health insurance market—in a RICO action against GlaxoSmithKline arising from the sale of adulterated pharmaceuticals manufactured at GSK’s Cidra, Puerto Rico facility (Blue Cross Blue Shield Ass’n, et al. v. GlaxoSmithKline LLC, E.D. Pa.). The litigation followed GSK’s guilty plea to FDCA violations and resulted in a favorable summary-judgment ruling and a substantial settlement on the eve of trial.
  • Regularly represents health insurers prosecuting pharmaceutical “pay-for-delay” antitrust claims, including In re Xyrem (Sodium Oxybate) Antitrust Litigation (D.N.J.), Aetna Inc. v. Jazz Pharmaceuticals, Inc. (Alameda County, CA), In re Revlimid & Thalomid Purchaser Antitrust Litigation (D.N.J.), In re Aggrenox Antitrust Litigation (D. Conn.), In re Lidoderm Antitrust Litigation (N.D. Cal.), and In re Wellbutrin XL Antitrust Litigation (E.D. Pa.).
  • Served on the litigation and trial team representing Humana in an off-label marketing fraud action involving Thalomid and Revlimid (Humana Inc. v. Celgene Corp., Pike County, KY).
  • Part of the Lowey Dannenberg team that recovered $219 million for unions and other investors in litigation arising from losses sustained in Bernard Madoff feeder funds.
